Lashes Original Payment Terms

The following terms (“Payment Terms”) govern the payments you make or receive through www.lashesoriginal.com (the “Site”), operated by Natiya Media LLC (headquartered at 2201 Menaul Blvd NE StA, Albuquerque, 87107, New Mexico, United States).
Please read these Payment Terms carefully before making or receiving payments through the Site. By making or receiving payments through the Site, you agree and undertake, on your own behalf or on behalf of your employer or another entity (if applicable), to comply with and abide by these Payment Terms. These Terms are in addition to Lashes Original’s General Terms of Service.
1. Key Terms
- "Payment Service Provider(s)" refers to Stripe, Inc. and its affiliates, which process payments between Customers and Sellers, Lash Artists, or Tutors in connection with the Lashes Original platform, including the collection of funds from Customers, the remittance and withdrawal of funds to Sellers, Lash Artists, or Tutors, currency exchange services (if applicable), and the processing of payments via Stripe Connect.
- "Earnings" refers to the money that Sellers, Lash Artists, or Tutors earn from completed orders and can withdraw through their account linked to Stripe, subject to these Terms.
2. Receipt of Payments
2.1 Overview
- Each course or service you sell and successfully complete will generate revenue for your account equal to the price of the course or service, minus the percentage corresponding to your account type at Lashes Original (Tutor, Owner, Lashist).
- Lashes Original will credit Sellers, Lash Artists, or Instructors once an order is completed and payment has been processed through Stripe.
- If an order is canceled and does not meet the return requirements set forth in the Terms of Use, the funds paid will not be refunded to the Customer.
- Sellers, Lash Artists, or Tutors are responsible for paying any direct or indirect taxes, including VAT, GST, or income tax, that may apply to them based on their residence, location, or other factors, under the laws of their jurisdiction.
- Appointment as a Limited Collection Agent: The Seller, Lash Artist, or Tutor appoints Lashes Original as its authorized collection agent on a limited basis solely for the purpose of accepting payments from Customers through Stripe and remitting those payments to the Seller, Lash Artist, or Tutor. The Customer’s payment to Lashes Original shall be deemed a payment made directly to the Seller, Lash Artist, or Tutor. If Lashes Original fails to remit such amounts to the Seller, Lash Artist, or Tutor, the latter shall have recourse only against Lashes Original and not directly against the Customer.
2.2 Withdrawal of Funds
- To withdraw your earnings, you must set up a Stripe account and link it to Lashes Original via Stripe Connect. This process begins once you complete one of our two VIP or Emprende programs, where you’ll gain access to a form. Through this form, you can find available stations at Lashes Original locations near you or open your own. After filling out this form, you can create and connect your Stripe account, through which you will receive your payments.
- Funds will be available for withdrawal once the payment process is complete and after any holding period required to comply with Stripe's policies.
- Sellers, Lash Artists, or Tutors can withdraw their earnings through the bank account linked to Stripe. Stripe may charge fees for withdrawals or currency conversion, depending on the location of the Seller, Lash Artist, or Tutor and the currency in which the payment is processed.
- Withdrawals are final and cannot be undone. We will not be able to reverse this process once it has begun.
3. Shopping
3.1 General Information
- Customers pay Lashes Original to place an order from a course or service page or through a personalized offer, and the payment is processed via Stripe.
- Lashes Original acts as a limited-scope payment processor to accept payments from Customers and forward those payments to Sellers, Lash Artists, or Tutors via Stripe.
- Customers can make purchases on Lashes Original using one of the payment methods supported by Stripe, such as credit cards, debit cards, and other methods that Stripe may offer.
- Service fees are added at the time of purchase, where you can review and accept the total amount due.
4. Taxes
- Lashes Original may be required by applicable laws to collect indirect taxes (such as VAT or GST) or to withhold taxes. Users are responsible for paying any direct or indirect taxes that may apply to them.
5. Cancellations, Changes, and Refunds
5.1 Cancellation and Rescheduling of Appointments
Cancellation Policy: Appointments may be canceled or rescheduled without penalty with at least 24 hours' notice prior to the scheduled appointment. If you cancel or reschedule within this timeframe, any deposit paid will be refunded.
Late Cancellations and No-Shows: Cancellations made less than 24 hours in advance or failure to show up for an appointment will result in the forfeiture of the deposit paid. In exceptional cases, the Vendor, Agent, or Lash Artist may allow rescheduling at no additional cost if the reason is justified.
5.2 Refunds for Services Rendered
Satisfaction Guaranteed: If you are not satisfied with the service you received, please notify us immediately so that the Vendor, Agent, or Lash Artist can offer an appropriate correction or solution. Services provided are non-refundable, but alternatives such as corrections or discounts for future appointments may be offered.
5.3 Exceptions
Force Majeure: In cases of emergency or force majeure, Natiya Media LLC and the Sellers reserve the right to make exceptions to these policies.
6. General Terms
6.1 Amendments
- Lashes Original may make changes to these Payment Terms from time to time. If you use Lashes Original after the date on which the Payment Terms have been changed, Lashes Original will treat your use as acceptance of the updated Payment Terms.
6.2 Limitation of Liability
- Lashes Original and its affiliates shall not be liable for any damages of any kind arising out of or in connection with your use of the Site, subject to reasonable professional diligence.
